These Terms and Conditions ("Terms") govern your use of this website and the photography, video, drone, content, and related media services provided by D. Hess Real Estate Media LLC, doing business as D. Hess Media Co. ("D. Hess Media Co.," "we," "our," or "us"). By using our website or booking our services, you agree to these Terms. If you do not agree, please do not use our services.

 

1. Services
D. Hess Media Co. provides real estate and business media services, including real estate photography, video walkthroughs, drone/aerial photo and video, floor plans, 3D tours, virtual staging, and monthly content and social media packages. Specific deliverables, pricing, and turnaround times are listed at booking or in your order, quote, or client agreement.

 

2. Eligibility
You must be at least 18 years old to book our services. By booking, you confirm that you have authority to do so and that the information you provide is accurate.

 

3. Booking, Access, and Scheduling
You are responsible for providing access to the property or job site at the scheduled time and for having it ready to photograph or film. Weather, safety, and FAA rules may require rescheduling drone or exterior work. Late cancellations or no-access appointments may be subject to a fee as stated at booking.

 

4. Payments and Fees
Payment terms are shown at checkout or in your invoice or client agreement. Where offered, eligible real estate orders may be paid at closing. Monthly content packages are billed monthly as described in your agreement. Unpaid balances may result in delayed delivery or suspension of services.

 

5. Usage Rights and Intellectual Property
D. Hess Media Co. retains copyright in all photos, video, and other media we create. On full payment, you receive a license to use the delivered media to market the specific property, project, or business it was created for, as described in your order or agreement. Media may not be resold or transferred to third parties (such as other agents or builders) without our written permission. We may use delivered media in our own portfolio and marketing unless you ask us not to in writing.

 

6. Communications and SMS
If you provide your phone number or email, you may receive calls, emails, or text messages about your inquiry, appointments, deliveries, and services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages or HELP for help. Phone numbers and SMS opt-in data are not sold or shared with third parties for their marketing purposes.

 

7. Third-Party Services
We use third-party platforms for booking, payment, delivery, and hosting. Your use of those platforms may also be subject to their terms and policies.

 

8. Limitation of Liability
To the maximum extent permitted by law, D. Hess Media Co. is not liable for indirect, incidental, or consequential damages, lost profits, or lost business opportunities arising from our services. Our total liability for any claim will not exceed the amount you paid for the services at issue.

 

9. Indemnification
You agree to hold D. Hess Media Co. harmless from claims arising from your misuse of our services or delivered media, or your violation of these Terms or applicable law.

 

10. Privacy
Your use of our services is also governed by our Privacy Policy.

 

11. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a new effective date.

 

12. Governing Law
These Terms are governed by the laws of the State of Tennessee and applicable U.S. law.
